1. Acceptance of Terms

By purchasing, downloading, or using any products or services from tickstack.io (“we,” “us,” or “our”), you (“User,” “you,” or “your”) accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our website or products.

2. Eligibility

You must be at least 18 years of age to use our services. By using tickstack.io, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. If you are accessing our services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Products and Services

3.1 Expert Advisors

We offer Expert Advisors (automated trading software) for the MetaTrader 5 platform. These are software tools designed to execute trades automatically based on predefined algorithms.

3.2 License Grant

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to use our EAs for your personal trading purposes only. This license does not constitute a sale of the software.

3.3 License Restrictions

You may NOT:

  • Redistribute, resell, lease, or sublicense our EAs
  • Reverse engineer, decompile, or disassemble the software
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the software for any illegal purposes
  • Share your license with others
  • Use the EA on more accounts than your license permits

4. Purchase and Payment

4.1 Pricing

All prices are displayed in the currency specified on our website and are subject to change without notice. Prices include applicable VAT where required by law.

4.2 Payment

Payment must be made in full at the time of purchase through our authorized payment processors. We accept payment methods as displayed at checkout.

4.3 License Activation

After successful payment, you will receive license information and download instructions via email. It is your responsibility to provide a valid email address.

5. Refund Policy

5.1 Refund Terms

We offer a 14-day]money-back guarantee from the date of purchase. To request a refund, you must:

  • Contact us within 14 days of purchase
  • Provide your order number and reason for refund
  • Cease all use of the software

Refunds will be processed within 14 business days of approval.

5.2 Refund Exclusions

Refunds will not be provided if:

  • You violated these Terms of Service
  • The refund period has expired
  • You purchased during a promotional period stating “no refunds”
  • You have previously received refunds for multiple products

6. Risk Acknowledgment

You acknowledge and agree that:

  • Forex and CFD trading involves substantial risk of loss
  • Our EAs are tools and do not guarantee profits
  • Past performance does not indicate future results
  • You may lose your entire investment
  • You are solely responsible for your trading decisions and results
  • You should not trade with money you cannot afford to lose

7. No Warranties

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The software will meet your expectations or requirements
  • The software will be uninterrupted, timely, secure, or error-free
  • The results obtained from the software will be accurate or reliable
  • Any errors in the software will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TICKSTACK.IO AND ITS OWNER SHALL NOT BE LIABLE FOR ANY:

  • Direct, indirect, incidental, consequential, or punitive damages
  • Trading losses or lost profits
  • Loss of data or business interruption
  • Damages arising from your use or inability to use our products

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.

9. Indemnification

You agree to indemnify, defend, and hold harmless tickstack.io, its owner, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our products
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your trading activities

10. Updates and Modifications

10.1 Software Updates

We may provide updates, upgrades, or modifications to our EAs at our sole discretion. We are not obligated to provide any updates or continued support.

10.2 Terms Updates

We reserve the right to modify these Terms at any time. Material changes will be notified via email or website notice. Your continued use after such changes constitutes acceptance of the new Terms.

11. Termination

11.1 Termination by Us

We may terminate or suspend your license immediately, without prior notice, if you:

  • Breach these Terms
  • Engage in fraudulent activity
  • Use the software for illegal purposes

11.2 Effect of Termination

Upon termination:

  • Your license to use the software immediately ceases
  • You must cease all use and delete all copies of the software
  • Sections that by their nature should survive (including liability limitations) remain in effect

12. Intellectual Property

All content on tickstack.io, including EAs, code, algorithms, text, graphics, logos, and trademarks, are the exclusive property of tickstack.io and are protected by copyright and intellectual property laws. Unauthorized use is strictly prohibited.

13. Third-Party Platforms

Our EAs operate on the MetaTrader 5 platform developed by MetaQuotes Software Corp. We are not affiliated with MetaQuotes or any broker. You must:

  • Have a valid MT5 account with a broker
  • Comply with your broker’s terms of service
  • Have appropriate VPS or computer infrastructure if required

We are not responsible for issues arising from the MT5 platform, your broker, or your trading infrastructure.

14. User Conduct

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Interfere with or disrupt our services
  • Attempt to gain unauthorized access to our systems
  • Transmit any viruses, malware, or harmful code
  • Violate any applicable laws or regulations

15. Privacy

Your use of tickstack.io is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Disclaimers

16.1 Not Financial Advice

Nothing on tickstack.io constitutes financial, investment, or trading advice. We are not licensed financial advisors. Consult a qualified professional before making investment decisions.

16.2 Performance Claims

Any performance results shown are for informational purposes only. They do not guarantee that you will achieve similar results. Individual results will vary based on numerous factors.

16.3 Independent Contractors

No agency, partnership, joint venture, or employment relationship is created between you and tickstack.io through these Terms or your use of our products.

17. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions.

17.2 Jurisdiction

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Cyprus.
